Federal judge allows expelled UF student’s lawsuit to proceed to trial

A federal judge has refused to dismiss a lawsuit brought by a University of Florida student who was expelled after posting an anti-Semitic message on social media. Judge Allen Winsor denied UF’s motion to dismiss following a telephone hearing Monday, allowing the case to move forward. A jury trial is set to begin May 27.
Point / Counterpoint
The Ledger is neutral; these essays are not. Each side, as steel-manned as we can make it.
Point
The expelled student’s lawsuit deserves its day in court because the First Amendment protects even offensive speech, and a university that punishes a student solely for a social media post — without demonstrating a concrete, credible threat — risks overreaching its disciplinary authority in ways that chill free expression on campus.
Counterpoint
UF’s defense attorneys argue the post constituted a genuine threat to Jewish students on campus, not merely offensive opinion, and universities have a legal and moral obligation to protect their communities from content that crosses the line from protected speech into intimidation or harassment.
